All of the questions and answers below assume that
you are the victim of another driver's negligence and that someone else caused the accident.
- Should I go to the doctor?
If you are injured and would benefit from medical treatment,
you should see a doctor.
- How can I pay for medical
treatment?
Your own auto and health insurance can be used to pay bills. If you
do not have your own insurance, some doctors are also willing to
wait to be paid until your injury claim is settled if you do not
have your own insurance. In the long run, it is best if the at-fault driver's insurance company pays
all your medical costs, but they will not normally pay for your
treatment until the claim is finished.
- Should I talk to an insurance
adjuster?
You should think carefully before talking to any
adjuster. If you anticipate needing to make an injury claim, it may
be
a good idea to consult with an injury lawyer first.
- What is going to be done about my
wrecked car?
If the other driver was insured, the cost of repairs should be paid by
their insurance. If your car was a total loss, you
will be paid the full market value of the car. If the other driver
was not insured, your own collision coverage could be used.
- Should I get a rental car?
Probably. However, it's best if the rental car is approved for direct payment from the
at-fault driver's insurance company before you rent it. Also, the
rules about collision coverage on a rental car and when the rental
can be cut off can be very confusing. You need to have a very clear
agreement about what the insurance company has approved and what
they will pay for.
- Do I have a case?
If you were injured in an accident that was caused by someone else's
negligence you probably have a claim. The circumstances of your
accident and injuries will need to be needed by your attorney to
give you a better idea about the strength of your claim.
- What is an individual accident
report? Do I need to fill one out?
An individual accident report is very similar to a police report and
must be filled out within ten days of the accident if there was over
$1,000 damage or if there were any injuries.
- Should I hire a lawyer?
If you were injured in an accident caused by another person's
negligence, you should consider hiring a lawyer.
- How are my services paid for?
I work on a contingent fee basis. There is no up-front retainer fee
and we only get paid if there is a recovery.
